Wyoming security deposit: 30 days to get it back

The owner must deliver or mail the balance of the deposit and prepaid rent, with a written itemization of deductions and reasons, within 30 days after the rental agreement ends, or within 15 days after receiving the renter's new mailing address, whichever is later. If the unit is damaged, that period is extended by 30 days.

What the law requires

Itemized statement
A written itemization of deductions with reasons is required. Permitted deductions include accrued rent, damage beyond reasonable wear and tear, cleaning costs and other costs the agreement allows. The state court's tenant form instructions say to supply a statement and copies of receipts if keeping deposit money. A separate utility deposit is refunded within 10 days after proof utilities were paid.
Forwarding address
The renter is expected to tell the owner, within 30 days after the rental ends, where to mail payment and notices. If the new mailing address arrives late, the owner has 15 days from receiving it, if that is later than the 30 days.
If the landlord breaks the rules
If the owner unreasonably fails to comply, the renter may recover the full deposit and court costs. If the owner prevails and the court finds the renter acted unreasonably, the owner may recover court costs. No statutory double or triple damages; attorney fees are not mentioned.
Deposit cap
No statutory cap found.
Small claims limit
$6,000 in Circuit Court (Small Claims)

If your landlord misses the deadline

  1. Write down your dates and gather proof: move-out date, the date you gave your forwarding address, the deposit amount, and anything the landlord sent. Photos and receipts help.
  2. Send a written demand by certified mail, keep the receipt, and cite Wyo. Stat. § 1-21-1208. Give a date to respond.
  3. If you still aren't paid, file in Circuit Court (Small Claims). Deposit claims up to $6,000 can be filed there, usually without a lawyer. Check the court's website for current filing fees and forms.

[A.] I have not received my deposit or an itemized statement of deductions. Under Wyo. Stat. § 1-21-1208, a landlord must return a tenant's security deposit, or send an itemized statement of any deductions, within 30 days after the tenant moves out and gives a forwarding address. That deadline passed on [deadline date].
